1. General Information

 

This document is a public offer of Elena Zaycman (hereinafter, “Seller”) to conclude a sales agreement with any individual (hereinafter, “Buyer”) under the terms below.

By using the website lenazaycman.art, the Buyer agrees to this Public Offer, the Privacy Policy, and the use of cookies.

2. Subject of the Agreement

 

Seller offers Buyer the opportunity to purchase:

• Original art objects and decorative items (physical products);
• Digital products, including patterns and online masterclasses, etc.;
• Custom-made art objects created to order.

 
3. Ordering and Payment

Physical and Digital Products:

Orders are placed via the website or email. Payment must be made in full (100%) via PayPal. After payment, Buyer will receive an order confirmation from the website.

 

Custom Orders:

For commissioned works, Buyer pays a deposit of 100 USD (or equivalent) for the creation of a design sketch. This amount covers the work on the sketch. For especially large or complex projects, Seller may set a higher sketch fee. If Buyer approves the sketch and confirms the order, the deposit is credited toward the total price. The final price of the item is determined after approval of the sketch. Full payment is required before production begins. Production time and shipping terms are agreed individually.

 

Buyer may cancel an order only within 3 hours of placing it, before production or shipment has begun. In case of cancellation, refunds are issued minus any actual expenses incurred. Cancellation of digital product orders is not possible.

 

All prices are listed in U.S. dollars (USD). Payments are processed in USD via PayPal, and any currency conversion fees are the responsibility of the Buyer.

 

 

4. Shipping and Delivery

 

Physical objects are shipped via postal or courier services. Shipping costs and times are calculated individually and are not included in the item price. Items are usually shipped within 3–5 business days after payment unless otherwise agreed.

 

Risk of loss or damage to the item passes to the Buyer once the item is handed over to the shipping service. The Seller ensures proper packaging and will assist the Buyer in resolving any issues with the carrier.

 

Buyer is responsible for payment of all customs duties, taxes, and fees that may apply to international delivery. Seller is not responsible for delays related to customs clearance, additional fees, or duties imposed by customs. Due to specific customs and postal regulations in some countries, customs duties or other fees may be charged at the time the parcel is shipped, rather than upon delivery as is usual elsewhere. If this occurs, the Buyer is responsible for payment of any applicable fees.

 

In exceptional circumstances beyond Seller’s control (international shipping restrictions, postal delays, import regulations, customs clearance, duties, etc.), shipping times may be extended. In case of force majeure, Seller will notify Buyer and suggest possible solutions.

 

Digital products (patterns, masterclasses) are delivered electronically. After payment, Buyer immediately receives an automated email containing a link to the page and a password, where they can download the purchased pattern or access the online masterclass. Access to video materials of online masterclasses is granted manually based on the Buyer’s YouTube email within 2 business days.

 

Access duration:

• Masterclasses: 3 months from access date
• Patterns: unlimited

The Buyer receives a non-exclusive license to use the digital materials (patterns) for personal and/or commercial purposes. The pattern itself may not be resold, redistributed, or used for resale in its original form, but the Buyer may sell finished products made using the pattern.

 

The Buyer receives a non-exclusive license to use the digital materials (masterclasses) for personal use only. Redistribution, resale, or use of the materials for commercial purposes is prohibited.

 

 

5. Returns and Exchanges

 

Physical products may be returned within 14 days in original condition; shipping costs for returns are the responsibility of the Buyer.

 

Custom-made items are non-refundable. Digital materials are non-refundable due to their intangible nature, except in cases where a file is defective or sent incorrectly.

 

To request a return, email lena.zaycman@gmail.com with order number, date, and reason. Refunds are processed within 30 calendar days after the Seller receives the returned item.

 

 

6. Rights and Responsibilities

 

Seller:

• Provides accurate information about products;
• Ships purchased items on time;
• Confirms orders via email.

Buyer:

• Provides accurate contact information;
• Makes timely payment;
• Receives and accepts purchased items according to the agreed delivery and order terms;
• Uses digital products in accordance with Seller’s copyright.

 

 

7. Liability

 

Seller is not responsible for:

• Delays or damages caused by postal/courier services;
• Errors by Buyer when providing contact information;
• Technical issues affecting access to digital products;
• For any indirect, incidental, or consequential damages.

 

 

8. Dispute Resolution

 

All disputes arising from this agreement shall be resolved through friendly negotiations between the parties. If an agreement cannot be reached, disputes may be resolved under the applicable law in the jurisdiction of the Seller.

 

 

9. Validity of the Offer

 

This offer is effective upon publication on lenazaycman.art and remains in force until withdrawn. Seller may change terms without prior notice; changes take effect immediately upon posting on the website.
